Following public offer is obligatory to fulfil by both parties.

1. KEY DEFINITIONS

1.1 Site - the website of the webshop www.autopigment.com with webpages.

1.2 User - a person, resident or non-resident of Ukraine of 18+ years old having legal capacity to use this site, buy goods via this site which agreed to this offer and its terms.

1.3 Buyer - a User which ordered a product (or products) from the autopigments.com.

1.4 Administration - implies to site administrator and webshop owners.

1.5 Seller - a person as a private entrepreneur which sells products on this Site. Administration can also be a Seller or it can grant rights to sell products via autopigments.com.

1.6 Public offer (further "Offer") is a pubic offering of a Seller, which allows to set up a contract with a Seller for the purpose of buying a product (or products) on autopigments.com and with conditions stipulated by this Offer including all its applications.

1.7 Order - a request of a User to buy a product (or products) through the Site or via a phone call to a Seller.

1.8 Payer - a person who pays for the Order.

1.9 Recipient - aт authorized by a Buyer person who receives the Order. A Payer can be a Recipient.

1.10 Product offer - a product data, its price, delivery, return and repayment conditions published by a Seller on the Site.

1.11 Sides - Seller, Buyer, User.

1.12 Product deliver - is a transfer of the ordered items from a Seller to a Buyer via delivery options described on this Site.

1.13 Delivery service - is a company which delivers orders to User according to selected type of delivery.

2. CONDITIONS

2.1 This offer defines the way of accessing information published on the Site, usage of the site and delivery options.

2.2 The Offer is public. By using Site's product content, instruments and applications User automatically and unconditionally accepts all conditions of this Offer.

2.3. By registering on the Site or by creating an order via the Site the User automatically and unconditionally accepts all conditions of this Offer.

2.4 Product content published on www.autopigments.com can be changed at any time and without prio notificaiton to any User.

2.5. Administration can unilaterally change conditions of this Offer. Any changes become effective right after published on www.autopigments.com

2.6. This Offer can only be accepted by a legally capable User over 18 years old. By accepting the Offer a User confirms his/her legal capability and takes full responsibility for the usage of the Site.

2.7 User makes an offer to a Seller by creating an order via the Site or via a phone call to the number published on the Site.

2.8 User's offer considered to be accepted by the Seller, if one performed actions which explicitely show the acceptance, to wit: delivered the order to a User.

2.9 Order payment and/or order delivery result in the acceptance of all conditions by both Sides.

2.10 Sides agree that any messages including, but not limited to: order acceptance, order status, delivery terms, product prices, payment methods etc. that were sent by the Seller and/or Administration to User, Buyer or Payer are solely for the purpose of informing the User/Buyer/Payer that an offer is received, yet this does not mean that one is confirmed and accepted by the Seller.

2.11 When offer is accepted, User agrees to receive product information via a distant method of communication. Signed delivery documents attest that a product (or products) were delivered to Recipient and confirm that one got all product information before a product was delivered.

3. DELIVERY

3.1 Delivery is made either to User's address or to a pick-up point of a delivery company.

3.2 If there is no office or a pick-up point of the company in a selected location, then a User can choose the nearest location where office/pick-up point available.

3.3 Seller does not take any responsibility for the actions of a delivery company.

3.4 The fact of a product reception is attested by signed delivery documents

3.5 User can appoint as a Recipient a third person. In this case User is obliged to provide complete, correct and accurate Recipient's data.

4. PRICES AND PAYMENT

4.1 Price per each product is published on the Site.

4.2 Seller may change prices for products or shipment. New prices are effective right after published on the Site and do not affect orders made before the change.

4.3 Payments between are done in either EUR or USD currencies via credit cards or invoices.

5. SIDES RESPONSIBILITY

5.1 User is obliged to follow Ukraine's Laws and do not perform any harmful or unlawful actions.

5.2 User is obliged to inform Administration in case of unathorized access to personal data or user page.

5.3 Reponsibility for payments are solely on banks, payment services etc. who perform such payments. The Seller and Administration doesn't take any responsibilty for payments processing.

5.4 The Seller and Administration is not repsonsible for the hardware where the Site is deployed, accessibility to the Site, malfunctioning of communication channels and other technical and hardware aspects.

5.5 User is responsible for completeness, accuracy and authenticity of his/her registration, delivery and contact information provided to the Seller/Administration.

5.6. In case incomplete, inaccurate or incorrect information provided by a User resulted in unexpected expenses of the Seller and/or Administration, then the Seller and/or Administration has the right to charge User for the amount of such expenses.

6. OTHER CONDITIONS

6.1 Any disputes or controversies must be resolved in the way of negotiations and if not possible, then with the help of Ukraine's Court. Ukraine Law is applicable and leading.

6.2. All rights, including but not limited to the Site, domain name, textual and graphics content, are reserved.

6.3 User acknowledges and agrees to this Offer.
